Terms of Service

Last updated: 24 October 2026

1. About Toshani London

Welcome to Toshani London.

These Terms of Service govern your access to and use of the Toshani London website, online store and related services.

In these Terms, “Toshani London”, “we”, “us” and “our” refer to the business operating the website at www.toshani.co.uk.

Business details

Our online store is hosted on Shopify, which provides the e-commerce platform that enables us to sell our products to you.

Please read these Terms carefully before placing an order. By using our website, you agree to these Terms to the extent applicable to your use of the website and any purchase you make.

Nothing in these Terms excludes or limits any rights you have under applicable consumer protection legislation.

2. Eligibility and use of our website

You may browse our website and purchase products for personal or household use, subject to these Terms.

When using our website, you agree to:

  • Provide accurate and up-to-date information when placing an order.
  • Use the website only for lawful purposes.
  • Not misuse, damage, disrupt or attempt to gain unauthorised access to our website or systems.
  • Not copy or use our content, images, branding or product designs without appropriate permission.

You are responsible for maintaining the confidentiality of any account credentials you create and for activity carried out through your account, subject to applicable law.

We may restrict or suspend access where reasonably necessary to protect our website, customers or business from misuse, fraud or security threats.

3. Our jewellery and product descriptions

Toshani London offers demi-fine jewellery, including earrings and other jewellery pieces described on our website.

We make reasonable efforts to ensure that product descriptions, photographs, materials, dimensions, colours, weights, finishes and other specifications are accurate.

Please review the individual product listing before purchasing, including any information about:

  • Base metals and precious-metal content.
  • Plating and finish.
  • Stones, pearls and other materials.
  • Product dimensions and weight.
  • Care instructions and any relevant product limitations.

Product colours and appearance may vary slightly depending on your screen, device settings and lighting conditions. Natural materials, including freshwater pearls and mother-of-pearl, may also display variations in colour, lustre, pattern or appearance.

These variations do not remove our obligation to supply products that match their description and meet applicable legal standards.

We may update product listings or discontinue products from time to time. Changes will not override rights arising from an order already accepted.

4. Prices, taxes and payment

All prices displayed to UK consumers will be in pounds sterling (£), unless expressly stated otherwise.

The price and applicable delivery charges will be displayed before you complete your purchase. Any applicable taxes will be included in the displayed consumer price where required by law.

If you are purchasing from outside the UK, additional customs duties, import taxes or other charges may apply, depending on the destination and applicable rules. We will provide relevant information where required, and you should check the applicable charges before ordering.

We accept the payment methods displayed at checkout. Payment processing may be provided by third-party payment providers.

By placing an order, you confirm that you are authorised to use the selected payment method and that the information you provide is accurate.

Prices, promotions and product availability may change. A change will not retrospectively alter the agreed price of an order that we have accepted, except where a lawful correction or other applicable contractual right permits otherwise.

We will not charge for optional extras unless you have actively agreed to purchase them.

5. Orders and acceptance

When you submit an order through our website, you are making an offer to purchase the selected products.

You will normally receive an order acknowledgement by email. This confirms that we have received your order but does not necessarily mean that we have accepted it.

We will confirm acceptance when we notify you that your order has been accepted or dispatched, as applicable to our order process.

We reserve the right to reject an order before acceptance where there is a legitimate reason, such as a product being unavailable, a genuine pricing or listing error, suspected fraud or an inability to verify the transaction.

If we cannot accept your order after payment has been taken, we will notify you and refund any amount due in accordance with applicable law.

Please check your order details carefully before submitting it. We may not be able to make changes once processing has begun. However, this does not affect any statutory cancellation rights you may have.

6. Shipping and delivery

We deliver to the destinations listed in our Shipping Policy and available at checkout.

Available delivery methods, charges and estimated delivery times will be displayed before you place your order or in our Shipping Policy.

Unless another period has been expressly agreed with you, we will deliver your order within the period required by applicable law, generally within 30 days.

Delivery dates and times are estimates unless we have expressly agreed to a specific delivery commitment.

If delivery is delayed, we will communicate relevant information where appropriate. If we fail to deliver within the applicable period, you may have the right to set an additional reasonable delivery period or cancel the contract and receive a refund, as provided by law.

We are not responsible for delays caused by circumstances outside our reasonable control to the extent permitted by law. This does not remove any applicable statutory rights or remedies.

Risk during delivery

For consumer orders, the risk of loss of or damage to the goods remains with us until the goods come into the physical possession of you or a person nominated by you to receive them, except where applicable law provides otherwise.

We will not transfer delivery risk to you merely because we have handed your order to a delivery carrier.

Please refer to our Shipping Policy for further information.

7. Order changes and cancellations

Once an order has been accepted and processing has begun, we may be unable to amend the products, delivery address or other order details.

Please contact us as soon as possible at contact@toshani.co.uk if you need assistance with an order.

Where a statutory right to cancel applies, you may exercise that right in accordance with Section 8 below, regardless of whether the order has entered processing, subject to applicable law.

Nothing in this section removes any right you may have to cancel an order before a contract has been concluded or any other applicable statutory right.

8. Statutory cancellation rights for online purchases

Under UK consumer law, customers purchasing most goods online have a statutory right to cancel their purchase without giving a reason.

For eligible purchases, you generally have 14 days from the day after you receive the goods to notify us that you wish to cancel. If your order is delivered in multiple consignments, the applicable cancellation period is calculated in accordance with the relevant legal rules.

After notifying us of cancellation, you generally have a further 14 days to return the goods.

To exercise your cancellation right, contact us at contact@toshani.co.uk with your order number and a clear statement that you wish to cancel.

Condition of returned goods

You may handle goods to the extent necessary to establish their nature, characteristics and functioning, as you would reasonably be able to do in a shop.

You may be responsible for any diminished value resulting from handling beyond what is necessary to inspect the goods, where permitted by law.

Please return jewellery securely packaged and include any original packaging, accessories and documentation supplied with the order where possible.

Exceptions

Certain goods may be excluded from statutory cancellation rights under applicable law. One relevant exception concerns goods made to the consumer's specifications or clearly personalised.

The exception does not automatically apply to all jewellery, earrings or products described as made to order.

We will identify any applicable exception clearly before purchase where required by law.

Nothing in this section limits your rights if a product is faulty, damaged or not as described.

9. Our voluntary 30-day returns policy

In addition to statutory rights, Toshani London may offer a voluntary 30-day returns policy as described in our Returns Policy.

The conditions of this voluntary policy, including eligibility, product condition, packaging requirements, return postage and any exclusions, will be set out in that policy.

Where our voluntary policy provides rights beyond your statutory rights, we will honour those additional rights in accordance with its terms.

Our voluntary policy does not replace, restrict or shorten your statutory cancellation rights or your rights in respect of faulty, damaged or misdescribed goods.

Please consult our Returns Policy before sending an item back.

10. Refunds

Where you validly cancel an eligible online purchase under statutory cancellation rights, we will refund the amounts required by law.

This generally includes the price of the returned goods and the cost of standard delivery originally paid. If you selected a more expensive delivery option, we are generally required to refund only the cost of our least expensive standard delivery option.

We may withhold the refund until we receive the goods back or you provide evidence that you have sent them back, whichever occurs first.

We will make the refund within the applicable legal timeframe, normally no later than 14 days after receiving the returned goods or receiving evidence that they have been sent back, as applicable.

Refunds will normally be made using the original payment method unless you expressly agree otherwise. We will not charge a fee for processing a statutory refund.

For eligible returns under our voluntary 30-day policy, we will apply the refund arrangements stated in our Returns Policy, provided those arrangements do not restrict your statutory rights.

For refunds relating to faulty or misdescribed goods, we will follow the remedies and timeframes required by applicable law.

11. Faulty, damaged or incorrect products

We want you to be happy with your purchase.

If your jewellery arrives damaged, is faulty, is incorrect or does not match its description, please contact contact@toshani.co.uk with your order number and details of the issue. Photographs may help us assess the problem, but they will not be an absolute requirement where they are not reasonably necessary.

Under the Consumer Rights Act 2015 and other applicable legislation, goods must meet the relevant requirements, including being of satisfactory quality, fit for purpose where applicable, and as described.

Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund, including the short-term right to reject faulty goods where applicable.

We will not require you to pay return costs where the law requires us to cover them.

Nothing in these Terms limits or excludes your statutory rights in relation to faulty, damaged or misdescribed products.

12. Jewellery care and product use

Please follow the care instructions supplied with your jewellery or displayed on our website.

Plated jewellery, pearls, mother-of-pearl and gemstones may require particular care. Exposure to perfume, cosmetics, chemicals, moisture, abrasion or improper storage may affect the appearance or longevity of some materials and finishes.

Normal wear and tear, accidental damage or deterioration caused by use contrary to supplied care instructions may affect the remedies available in a particular case. However, care instructions do not remove our responsibility for defects or failures that we are legally responsible for.

If you have a question about the materials, finish or care of a particular piece, please contact us before purchasing.

13. Intellectual property

Unless otherwise stated, the content on our website, including our brand name, logos, product photographs, written descriptions, graphics and original creative material, is owned by Toshani London or used with permission.

You may view and use this content for personal, non-commercial purposes in connection with browsing or purchasing from our store.

You must not reproduce, distribute, modify, commercially exploit or republish our content without prior permission, except where permitted by law.

Purchasing a product does not transfer any intellectual property rights in our branding, photographs or original designs.

Nothing in this section affects any rights belonging to third-party rights holders.

14. Reviews and customer feedback

If you submit a review, suggestion or other feedback, you confirm that it is genuine to the best of your knowledge and does not knowingly infringe another person's rights.

You grant us permission to use, reproduce and display your feedback for purposes connected with our business, website and marketing, subject to applicable law and any rights you retain.

We may moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, abusive, irrelevant or infringes intellectual property rights.

We will not present reviews in a misleading way or falsely represent reviews as genuine customer experiences.

Where reviews or endorsements are incentivised or otherwise commercially connected, we will make disclosures where required by law.

15. Third-party services and links

Our website may use third-party services, including Shopify, payment providers, delivery companies and other tools necessary to operate our store.

Third-party services may be subject to their own terms and privacy policies.

Links to third-party websites are provided for convenience. We are not responsible for the content or operation of external websites to the extent permitted by law.

Nothing in this section excludes or limits any liability that we cannot lawfully exclude or limit.

16. Website availability and security

We aim to keep our website available and functioning properly, but we cannot guarantee uninterrupted access or that the website will always be free from errors.

We may carry out maintenance, updates or security measures that temporarily affect availability.

We take reasonable steps to protect our website and customer transactions. You must not attempt to introduce malicious code, interfere with security features or access systems without authorisation.

This section concerns the availability and use of the website and does not reduce our obligations relating to products you purchase from us.

17. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes, where applicable, liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and liability for breach of statutory consumer rights.

Subject to the above, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, in accordance with applicable law.

We will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances for which we are not legally responsible.

Nothing in these Terms affects any remedies available to you under applicable consumer protection legislation.

18. Privacy and personal information

We process personal information in accordance with our Privacy Policy.

Information may be processed to manage orders, accept payments, arrange delivery, respond to enquiries, prevent fraud and meet our legal obligations.

Our store is hosted by Shopify, and relevant information may be processed by Shopify and other service providers involved in operating the store.

Please read our Privacy Policy for details of the personal information we collect, how it is used, who it may be shared with, how long it is retained and your applicable data protection rights.

19. Events outside our reasonable control

We will not be responsible for a failure or delay caused by circumstances outside our reasonable control, to the extent permitted by law.

Such circumstances may include severe weather, natural disasters, major transport disruption, industrial action, governmental restrictions or significant interruptions to essential services.

Where such an event affects an order, we will take reasonable steps to inform you and explain the available options.

This section does not remove any statutory rights you may have to cancel an order, obtain a refund or pursue another legal remedy.

20. Changes to these Terms

We may update these Terms from time to time to reflect changes to our business, website, products or legal obligations.

The current version will be published on our website with its updated date.

Changes will not retrospectively remove rights you have already acquired under an existing contract. Where changes affect an existing contract, we will comply with applicable legal requirements.

We encourage you to review these Terms periodically.

21. Complaints and customer support

If you have a question, complaint or concern about an order or our services, please contact:

Email: contact@toshani.co.uk

Please include your order number where relevant so that we can assist you efficiently.

We will review complaints fairly and aim to respond within a reasonable time.

Nothing in this section prevents you from exercising your legal rights or pursuing any remedy available to you.

22. Governing law and jurisdiction

These Terms and any dispute arising from them will be governed by the law of England and Wales, except where mandatory laws applicable to you provide otherwise.

If you are a consumer living in another part of the United Kingdom or another jurisdiction, you may also benefit from mandatory consumer protections and court rights available under the laws that apply to you.

Nothing in this section removes any right you have to bring proceedings in a court where applicable law permits you to do so.

23. General provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision immediately does not mean that we have permanently waived that right.

These Terms, together with the policies and information expressly incorporated into them, govern your use of our website and the relevant purchases, subject to any separate terms agreed with you and applicable law.

Nothing in these Terms overrides any mandatory statutory rights.
